Welcome to Cicmil Crowns Jewellery (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our services, website, applications, and products (collectively, the “Services”). By accessing or using our Services, you agree to comply with these Terms. If you do not agree to these Terms, you must not use our Services.

1. Acceptance of Terms

By accessing or using our Services, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use the Services.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we make changes, we will post the updated Terms on our website and indicate the effective date of the changes. Your continued use of our Services after the changes are posted will constitute your acceptance of the modified Terms.

3. Product Information

• Made-to-Order Designs: We do not carry a stock of pre-made rings available for immediate purchase. Each piece is individually crafted based on your specific order and requirements.
• Custom Ring Production: We work closely with you to produce your custom ring. During the production process, we will provide you with progress images and updates, ensuring you can see how the design is evolving. You will have the opportunity to approve the final design before we proceed with shipping. If at any point during production you are not satisfied with any aspect of the design, you can request modifications.

4. Production and Delivery Timeline

• Production Time: The production time for your custom ring can range from 30 to 90 days. The exact time depends on the materials used and our current workload. If you place your order during a busy period, it may take longer for us to start production.
• Custom Materials: If your design includes a gemstone or material that we do not have in stock, additional time will be required to acquire or cut the material to fit your specifications. We recommend planning ahead and allowing sufficient time for production and delivery.
• Shipping Location: All rings will be shipped from Mississauga, Canada. The customer is responsible for any import fees or duties associated with the delivery of the product.
• Tariffs for U.S. Customers: Customers in the United States should be aware of any new tariffs or import taxes imposed by the U.S. government, as these costs will be the responsibility of the customer.

5. Returns, Refunds, and Store Credit

• No Refunds: Given that you will receive images and videos of your custom ring throughout the production process and approve the final design before shipping, we do not offer refunds on completed orders.
• Store Credit: In the unlikely event that you are not fully satisfied with your ring after receiving it, we can offer store credit for the amount of the purchase, provided the ring is returned in its original condition. Please note, you will be responsible for covering the costs of shipping the item back to us including the customs fees in Canada.

6. Privacy

We respect your privacy and are committed to protecting your personal data. Please refer to our Privacy Privacy Policy for information on how we collect, use, and protect your personal data.

7. Intellectual Property

All content, designs, trademarks, logos, and other intellectual property related to our Services are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any of this content without our prior written consent.

8. Payments and Fees

If applicable, you agree to pay all fees associated with the Services, as outlined as communicated to you. Payments are non-refundable unless otherwise specified.

9. Termination

We reserve the right to suspend or terminate your access to our Services at our discretion, including if you breach any of these Terms. You may also terminate your account at any time by following the instructions in the account settings.

10. Disclaimers and Limitations of Liability

To the fullest extent permitted by law, we disclaim any liability for damages arising from your use or inability to use the Services.

In no event shall our liability exceed the amount you have paid for the Services during the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Cicmil Crowns Jewellery, its affiliates, employees, and agents from any claims, damages, or liabilities arising out of your use of the Services or any violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Canada. Any disputes arising out of or related to these Terms shall be resolved through binding arbitration, and you agree to submit to the jurisdiction and venue of the courts located in Toronto.

13. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Cicmil Crowns Jewellery regarding your use of the Services.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of those rights.
• Transfer: We may assign or transfer these Terms without restriction. You may not assign or transfer these Terms without our prior written consent.
